Terms & Conditions for Xansibar Design Affiliate Program

These Terms and Conditions (“Agreement”) govern the relationship between Xansibar Design (“Company”) and the individual or entity (“Affiliate”) participating in the Xansibar Design Affiliate Program (“Program”) to promote web and app design and development services offered by Xansibar Design.

1. Affiliate Program Acceptance:
By participating in the Program, the Affiliate acknowledges and agrees to comply with these Terms and Conditions.

2. Commission Structure:
2.1 Commission Rate: The Affiliate will receive a commission of 20% of the total amount (excluding taxes) for each new lead referred to Xansibar Design that results in a confirmed project.
2.2 Payment: Commissions will be paid within 20 days after the new lead has been confirmed and the project has started.
2.3 Payment Method: Commission payments will be made via Interac transfer to the Affiliate’s designated payment email account.

3. Tracking and Reporting:
3.1 Tracking: Xansibar Design will provide the Affiliate with a unique referral link or code to track leads referred by the Affiliate.
3.2 Lead Confirmation: Xansibar Design will confirm and validate leads referred by the Affiliate before commission payment is processed.
3.3 Lead and Payment Information: The Affiliate can access xansibar.com/affiliates to track and monitor the status of leads and view payment information.

4. Affiliate Responsibilities:
4.1 Promotional Efforts: The Affiliate agrees to promote Xansibar Design’s web design and development services using ethical marketing practices.
4.2 Compliance with Laws: The Affiliate will comply with all applicable laws and regulations governing the promotion and marketing activities related to the Program.
4.3 Prohibited Activities: The Affiliate will not engage in any activities that may damage the reputation or brand of Xansibar Design or engage in any deceptive or unethical practices.
4.4 Confidentiality: The Affiliate agrees to keep any confidential information shared by Xansibar Design, including customer and pricing information, confidential and not disclose it to third parties.

5. Term and Termination:
5.1 Term: This Agreement will commence upon acceptance by the Affiliate and will continue until terminated by either party.
5.2 Termination: Either party may terminate this Agreement at any time, for any reason, by providing written notice to the other party.
5.3 Effect of Termination: Upon termination, the Affiliate will no longer be eligible for commission payments for new leads.

6. Modifications:
Xansibar Design reserves the right to modify, suspend, or terminate the Affiliate Program or these Terms and Conditions at any time. Any changes will be communicated to the Affiliate in writing or through the xansibar.com/affiliates portal.

7. Governing Law and Jurisdiction:
This Agreement will be governed by and construed in accordance with the laws of Canada. Any disputes arising under or in connection with this Agreement will be subject to the exclusive jurisdiction of the courts of Vancouver, Canada.

8. Eligibility and Geographic Limitation:
8.1 Eligibility: Participation in the Xansibar Design Affiliate Program is open to individuals and entities who are legal residents of the United States or Canada.
8.2 Geographic Limitation: The terms and conditions outlined in this Agreement apply only to residents of the United States or Canada. Xansibar Design reserves the right to verify the residency of any Affiliate and may terminate the Agreement if the Affiliate is found to be ineligible based on residency requirements.

By reading this Agreement and creating an Affiliate account, the Affiliate confirms their understanding and agreement to comply with all provisions outlined herein.
